Without Process Servers West Palm Beach Legal Cases Will Get Bogged Down

By Margaret Evans

Most people will be hard presses to even imagine the enormous number of legal cases pending at any given time. Court calendars are fully booked for months, sometimes even years in advance. Legal firms have numerous cases to deal with, an enormous amount of information must be gathered and the entire system of legal proceedings are influenced by numerous factors, anyone of which can delay a case. With process servers West Palm Beach cases can at least proceed quicker.

There are strict laws that stipulate that all parties involved in a legal proceeding need to be aware of the fact or they must be made aware of the case. To this end, all relevant documentation must be made available to every party involved. This documentation must, in most cases, be handed personally to the individual concerned. In the past, sheriffs performed this duty but it has become an enormous burden, hindering the execution of their other duties.

The serving of all this many legal documents is a monumental task. These day the work is done by professional serving officials. Most of them work as independent professionals, serving documents on behalf of the courts, legal forms, large companies, government agencies and even the police. They are paid a fee for each case concluded. They also need to provide solid proof that delivery has been made in person.

In order to enter this profession, one needs to be licensed. In many states, formal training is required but in some states the only criteria are that the applicant must not have a criminal record and his credit history needs to be clear. Ex law enforcement officers often enter this career and most private investigating forms also have a section dealing with the serving of legal documents.

Contrary to popular belief, serving legal papers is not an easy, straight forward job. In many cases the intended recipient must first be located. People move around, sometimes far away and locating them can take time. There are also many recipients that know very well that a case cannot be proceeded unless they have been served. They therefore deliberately hide from the server.

If finding some intended recipients is not difficult enough, serving professionals also have to deal with hostile people and situations. Some recipients are abusive and may even become violent. There has been many cases of assault too. Some professionals are even licensed to carry side arms. The police will only help if they are convinced that the serving official is in danger. By the time they agree, the recipient has often disappeared once more.

Another major obstacle every server has to deal with is the strict laws governing trespass. Under no circumstances may the server trespass on private property in order to serve documents. This can make things very difficult for them, especially if one consider the modern trend of high security apartment building, walled housing estates with strict access control and homes with advanced security systems in place.

There can be no doubt that serving professionals play an important role in the bigger justice system. No case can proceed until they have served all the papers to all the intended recipients. The more efficient they are, the more efficient the justice system becomes.
