Probate may have different meanings depending on context in which it is being used. It could refer to the process of presenting a will to court for filing purposes. On the other side, it could refer to a process of administering and processing an estate using correct legal procedures, after the death of the estate owner. Family probate is very important in ensuring that property is distributed in an orderly manner.

Nowadays, estate left behind by the dead person, is usually probated whether there is a will or not. However, with a will that is valid, the probation process becomes simple and straightforward. This is because the property owner has clearly outlined best ways in which his or her properties should be shared. Will also states the people who should receive a share of the property.

In case there is absence of a will, or the available one does not cover everything, there is law that helps in ensuring that there is fairness in property distribution. He or she has the right of inspecting books of account so as to make sound mind decision when clearing debts. Once he or she announces the death of property owner, people interested with the property of deceased may do application.

Inventorying stage is important because payment of debts and also distribution of property to the beneficiaries are done in right manner. The process is also important in ensuring that all the assets available are accounted for. In case of a missing property, right procedure is followed with intention of acquiring it back.

Next stage involves distribution of property of estate. It is important to note that, distribution of property to beneficiaries is done after creditors have been settled. If the entire process is conducted as required personal representative is usually protected by the law from any issues that may arise in future.
