How A White Collar Crime Attorney Handles Cases

By Charles Turner

If one has watched movies like Wolf of Wall Street with Jordan Belfort creating a really large scam, then he or she is probably familiar with white collar crimes. These kinds of crimes are extremely prominent in the business world but are so complicated to crack because of the nature of the fraud. Of course, the accused will also have their own white collar crime attorney to help them out.

As stated above, these kinds of crimes are rather complicated to investigate because business owners can actually hide their activities in various number of layers and companies until all the evidence is too hidden down under to be found. That is why it takes very intelligent individuals to really pull off these kinds of crimes. These are the types of crimes that involve a large sum of money being embezzled for personal gain.

Now, the complicated thing about this type of case on the side of the prosecution is trying to piece everything together. Even if some sort of pieces were found, the prosecution still has to try to force everything to come together to explain that in court. Of course, the defense lawyers will be more than willing to break down the case.

Just to give an idea, some examples of big money activities are money embezzlement, insider investing, tax evasion, and most of all money laundering. On the internet, there is also what is known as computer hacking, internet scams, information and identity theft, and unauthorized surveillance. For government practices, there would be counterfeiting, corruption, and public funds theft.

Now, if ever the accused reaches his or her way to court, then the lawyer will have to bring in some arguments to convince the court. Now, just to give an idea, the whole goal of the attorney is to either make sure that the case is won or that the sentence will be more lenient as compared to the maximum sentence. Of course, this goal will all depend on how good the lawyer is.

One of the most effective arguments made by these defense lawyers would be entrapment which is the defendant raising the possibility that law enforcement persuades someone to do a criminal act. In this case, the government will have to prove that there was no entrapment in order for the prosecution to hit the defendant. If not, then the defendant still has a strong ground.

Of course, there is a possibility that the government would prove that there is no entrapment involved. If ever the case of the defendant is getting weaker, then the lawyer would have to try to make the sentence more lenient. Some of the possible punishments would be confiscated assets, big fines, home arrest, and jail sentences.

A good defense attorney will be the deciding factor as to what the punishment of the accused will be and how severe it is. That is why getting a really good lawyer is very important if one is accused of this type of criminal activity. The things mentioned above are some of the things that these type of attorneys would handle.
